Probate is the court procedure by which a will is proved to be valid or invalid.  Today probate has been expanded to generally include all matters and proceedings pertaining to the administration of the estate.  This process can take a year or longer depending on the complexity of the estate, and cost upwards of 6% of the value of the estate.

By establishing a Living Trust, assets of the estate pass directly to the named love ones of the Trust.
